Terms of use

These terms govern the use of the OOUR mobile app and the OOUR web application (together the “Platform”) by workers, coordinators and managers. The relationship between OOUR and the Company subscribed to the Platform is governed by a separate service agreement and data processing agreement; in case of conflict those agreements prevail.

1. Who we are and what the Platform is

The Platform is provided by KYUBIX DOO BEOGRAD, Bulevar kralja Aleksandra 314, Belgrade, Republic of Serbia, registration number 22188933, tax ID 115653879 (“OOUR”). OOUR is the name of the product and brand; KYUBIX DOO is the company behind it. The Platform is used to schedule shifts, verify presence on site by location and calculate hours worked. OOUR is not your employer, does not pay wages and is not a party to your contract with the Company.

2. Acceptance of the terms

By signing in to the app with the code you received by message, or by signing in to the web application, you confirm that you have read and accepted these terms and the Privacy Policy. If you do not agree, do not use the Platform and contact your Company for another way of recording your hours.

3. Who may use the Platform

The Platform may be used only by persons the Company has invited: workers through an invitation to their phone number, coordinators and managers through an account created by the Company’s manager. You must be at least 18 years old. Use on behalf of another person is not permitted.

4. Account, sign-in and device

• Workers sign in with a phone number and a one-time code valid for 10 minutes. The code is personal: do not share or forward it.
• One active session per worker is allowed. Signing in on a new device automatically signs out the previous one.
• You are responsible for the device you use the Platform on and for all actions taken from your account until you notify us of misuse at contact@oour.app.
• Web users must keep their password confidential and not share it with others in the Company. Every person must have their own account, because the audit trail is tied to the account.

5. Rules of use

It is prohibited to:

• fake your location (mock location apps, modified devices) or otherwise mislead the system about your presence;
• leave the device with another person or on the site so that presence is recorded without you;
• check in for another person or use someone else’s account;
• submit photos not taken at the moment of check-in, or photos of other people without their consent;
• attempt to access data of other workers or other Companies, disrupt the Platform or bypass security measures;
• copy, decompile or resell the Platform.

Attempts to fake location are recorded by the Platform in the audit trail visible to the Company.

6. Accuracy of records and the Company’s role

The Platform calculates a proposal of hours worked from data about time spent in the site zone, under rules set by the Company (check interval, paid break, rounding, overtime). The final record and payroll are determined by the Company, which may enter corrections with a mandatory reason, within 15 days of the day of the task. Every correction is visible in the audit trail.

If you believe your hours were recorded incorrectly, contact your Company. OOUR does not decide on hours or payments and does not mediate labour disputes, but will provide the Company on request with the complete data chronology for the disputed day, which the Company can share with you.

Lack of signal, a switched-off device, an empty battery or a declined location permission may result in hours not being recorded automatically. The app warns you about this, and gaps in the data are shown to the Company as “no signal” so that it can record them manually.

7. Content you submit

Photos, cancellation reasons and other inputs remain yours. You grant OOUR and the Company the right to store and display them for the purposes described in the Privacy Policy, for the periods stated there. You are responsible for your inputs being accurate and not infringing the rights of others.

8. Intellectual property

The Platform, its code, design, logo and documentation are the property of OOUR or its licensors. You receive a limited, non-transferable, non-exclusive right to use the app on your device for the purposes of these terms, for the duration of your engagement and the Company’s subscription.

9. Availability and changes to the Platform

We strive to keep the Platform running without interruption, but do not guarantee uninterrupted availability. We announce maintenance to the Company at least 24 hours in advance, except in emergencies. We may change, add or remove features; material changes for workers are announced in the app.

The app depends on third-party services (the device operating system, app stores, carrier networks, message and notification delivery) that we do not control.

10. Disclaimer of warranties

The Platform is provided “as is”. To the extent permitted by law, we do not warrant that location data will always be accurate (accuracy depends on the device, GPS signal and surroundings), that messages and notifications will always be delivered, or that the Platform will meet every need you have.

11. Limitation of liability

To the extent permitted by law, OOUR is not liable for indirect damage, lost earnings or damage arising from the Company’s decisions on records and payment, from inaccurate data entered by the Company, from your breach of these terms, or from circumstances beyond our reasonable control. Nothing in these terms excludes liability that cannot be excluded by law, including liability for damage caused intentionally or by gross negligence and your rights under data protection law.

12. Termination

You may stop using the Platform at any time by signing out, and delete your account under section 9 of the Privacy Policy. The Company may deactivate your engagement, after which you lose access to its data. OOUR may suspend an account that breaches section 5, with notice to you and the Company, and remove it permanently if the breach is repeated.

13. Governing law and disputes

These terms are governed by the law of the Republic of Serbia. The courts of Belgrade have jurisdiction, unless mandatory consumer or labour protection rules in your country of residence provide otherwise. Before going to court we will try to resolve the dispute by agreement within 30 days of your written notice to contact@oour.app.

14. Changes to the terms

We publish changes on this page with a new date. We notify you of material changes in the app at least 15 days before they take effect. Continued use after that period constitutes acceptance of the changes.
